Military prosecutors have accused1st Lt. Michael C. Behenna of taking his prisoner, Ali Mansour Mohammad, to a remote desert location, stripping him naked, firing two pistol rounds at him and watching as another soldier, Staff Sgt. Hal M. Warner, set off a grenade under his head.

Prosecutors opened a case Sunday against Behenna, 25, charged with premeditated murder, at Camp Speicher, a large US base in northern Iraq.

Behenna is also of trying to cover up the alleged killing.

The key testimony against the US soldier comes from a witness, an Iraqi translator only as 'Harry', who told the hearing he saw Behenna shooting Mohammad in a tunnel on May 16.

Harry's real was not revealed fore security reasons. Iraqi translators for US forces are at risk of being killed by their fellow countrymen as traitors.

The Iraqi translator said the alleged killing came on the day that Behenna was supposed to release the detainee. As Behenna, Warner and Harry prepared to leave on that mission, he said Behenna told the detainee: "Today, I am going to kill you.''

During cross examination, defense attorney Jack Zimmermann attempted to cast doubt on Harry's reliability as a witness.

Zimmermann stressed that the shooting took place in a tunnel at dusk on a dusty day with no lights nearby, and that Harry's visibility would have been poor.

The two US soldiers face charges of premeditated murder, assault, making a false official statement and obstruction of justice, according to the US military.

They could face life in prison without parole if tried and convicted.

Behenna, from Edmond, Oklahoma, is the son of Vicki Behenna, a federal prosecutor who helped convict Oklahoma City bomber Timothy McVeigh to death for his role in the 1995 Oklahoma City bombing.
